Insurance subrogation. Power pole malfunctioned. A fire ensued in homeowner's residence. The fire originated at an extension cord attached to the television, which had suffered a power surge from the power pole. Homeowner's insurer paid claim and sought subrogation from utility company and its maintenance company for installing faulty connection on power pole Defendants claimed that a defect in the extension cord , causing it not to be able to withstand the power surge, caused the fire. Plaintiff argued the extension cord was not defective and that the power surge caused the fire and caused sparks, smoke, spot fires and other power-related problems in numerous other neighboring homes at the same time.
